In both the example ads you displayed from Asda and M&amp;S, they prominently use their own branding - minimal chance of confusion - so they will be able to continue with these ads even if this opinion becomes law.

Also, many small to mid sized companies do not even have this level of protection, as they have not trademarked their brands.</description>
